Terms of Use

These Terms of Service ("Terms") govern your use of the Task Nest mobile application ("the App"), operated by Tranquil Mind Technology JSC ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the higher minimum age of digital consent in your country) to use the App. By using the App, you represent that you meet this requirement.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial purposes. You may not copy, modify, distribute, sell, lease, or reverse-engineer the App except to the extent that applicable law expressly permits.

3. The Service

Task Nest is a to-do list, habit tracker, and focus (Pomodoro) app that helps you plan tasks, build habits, and stay organized. Core features work offline and store data locally on your device. Creating a free account (email and password) is optional and enables secure cloud sync of your content across your devices. Availability of features may vary and change over time, and we may modify, suspend, or discontinue the App or any feature at any time.

4. Accounts

If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate information and to notify us of any unauthorized use. You may delete your account and associated cloud data at any time by contacting us at contact@tranquilmind.co; see our Privacy Policy for details.

5. Pricing

Task Nest is free to use. It contains no advertising and no in-app purchases or subscriptions. If this changes in a future version, we will update these Terms and disclose any charges before they apply.

6. Your Content

You retain ownership of the tasks, habits, notes, images, and other content you create in the App ("Your Content"). Your Content stays on your device unless you sign in and enable cloud sync, in which case it is stored in your private cloud storage solely to provide the sync feature to you. You are responsible for Your Content and for keeping your own backups. We do not claim ownership of Your Content and do not use it to train models or for advertising.

7. Acceptable Use

You agree not to use the App to: (a) break any law or infringe others' rights; (b) disrupt, damage, or gain unauthorized access to the App or its systems; (c) use bots, scrapers, or automated means to access the App; or (d) attempt to bypass security or access controls. We may suspend or terminate your access for violations.

8. Intellectual Property

The App, its design, source code, logos, and trademarks are owned by Tranquil Mind Technology JSC or its licensors and are protected by intellectual-property laws. Third-party marks belong to their respective owners; their appearance does not imply affiliation or endorsement.

9. Third-Party Services

The App uses third-party services (Google Firebase for authentication, cloud sync, and crash reporting) to operate. These services are governed by their own terms and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure, or that reminders and notifications will always be delivered on time — their delivery depends on your device's operating system, notification, and battery settings. The App is a productivity tool and does not provide professional advice of any kind.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or content. Our total liability for any claim relating to the App is limited to the greater of the amount you paid us in the last 12 months (which for a free app is USD 0) or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Tranquil Mind Technology JSC from any claims, damages, or expenses arising from your misuse of the App or your breach of these Terms.

13. Termination

We may suspend or terminate your access to the App at any time, including for breach of these Terms. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of Vietnam, without regard to conflict-of-laws rules. The venue for disputes is Hanoi, Vietnam. Any mandatory consumer-protection rights available to you under your local law are preserved.
