Terms of Service

These Terms of Service ("Terms") govern your use of the Swift Secure VPN mobile application ("the App"), operated by Tranquil Mind Technology JSC ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old (or the higher age of digital consent in your jurisdiction) to use the App. By using it, you represent that you meet this requirement.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App for your own lawful, non-commercial purposes. You may not copy, modify, distribute, sell, lease, or reverse-engineer the App or any part of it, except to the extent this restriction is prohibited by applicable law.

3. The Service

Swift Secure VPN is a free, ad-supported VPN application that establishes an encrypted connection to help make your browsing more private, with a choice of server locations. Availability, servers, and features may vary by region and may change over time. We may modify, suspend, or discontinue all or part of the App at any time.

The App is a privacy tool. It does not make you fully anonymous, does not guarantee that any third party cannot identify you, and is not a substitute for safe and lawful online behavior. You are solely responsible for how you use the connection and for complying with the laws that apply to you.

4. Ads and Rewarded Content

The App is free to download and use and is supported by advertising, including ads delivered through third-party mediation partners. The App may offer optional rewarded video ads — for example, to unlock additional VPN server locations. Watching rewarded ads is entirely optional.

The App does not offer subscriptions or in-app purchases and does not collect any payment information. If this changes in the future, any paid features will be sold through Google Play Billing and disclosed with the applicable pricing and renewal terms.

5. Acceptable Use

You agree not to use the App to: (a) break any law or regulation, or infringe others' rights; (b) access, distribute, or store unlawful, harmful, or infringing material; (c) disrupt, overload, or interfere with the App, our servers, or other users; (d) bypass or interfere with ads, security, or access controls; or (e) use bots, scrapers, or automated means to access the App. We may suspend or terminate your access for any violation.

6. Intellectual Property

The App, its design, software, trademarks, and content are owned by Tranquil Mind Technology JSC or its licensors and are protected by law. Third-party names and marks belong to their respective owners; their appearance does not imply affiliation with or endorsement by us.

7. Third-Party Services and Content

The App uses third-party services (advertising, analytics, crash reporting, and messaging) and routes your traffic to the internet, where you may access third-party websites and content. Each third party is governed by its own terms and privacy policy, and we are not responsible for their services or content.

8. Disclaimers

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted, error-free, secure, or private operation. Connection speed and reliability depend on factors outside our control, including your network, distance, and server load.

9. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill. Our total liability for any claim relating to the App is limited to the greater of the amounts you paid us in the 12 months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Tranquil Mind Technology JSC and its officers, employees, and partners from any claims, damages, or expenses arising out of your misuse of the App or your breach of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time, including for breach of these Terms. Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Your continued use of the App after changes take effect constitutes acceptance.

13. Governing Law and Disputes

These Terms are governed by the laws of Vietnam, without regard to conflict-of-laws rules. The courts of Hanoi, Vietnam have jurisdiction over any dispute, subject to any mandatory consumer-protection rights available to you under the laws of your country of residence.
