Terms of Service

These Terms of Service ("Terms") govern your use of the Pixa AI mobile application ("the App"), operated by Tranquil Mind Technology JSC ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the higher age of digital consent in your country) to use the App. By using the App, you represent that you meet this requirement.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use. You may not copy, modify, distribute, sell, or reverse-engineer the App except to the extent the law permits.

3. The Service

Pixa AI is an AI avatar and art studio: it turns your selfies and photos into AI-generated avatars, artwork, and videos, and provides AI photo tools (enhance, expand, remove object, on-device background removal). AI-generated results are stylized interpretations and may not exactly match your input. Availability of features may vary by region and change over time; we may modify, suspend, or discontinue any part of the App.

4. Your Content and AI-Generated Output

Your input. You are responsible for the photos and images you upload. You represent that you own them or have the necessary rights and permissions, and that they do not infringe anyone's rights or contain unlawful, sexually explicit, or otherwise prohibited content. Do not upload images of other people without their consent.

Your output. Subject to these Terms and the terms of our AI providers, you may use the images and videos you generate for personal purposes. AI output may be watermarked unless removed via a Premium plan.

Prohibited generations. You must not use the App to create content that is illegal, harmful, harassing, hateful, sexually explicit, deceptive (e.g. deepfakes intended to mislead), or that impersonates others or violates their rights.

5. Subscriptions, Purchases, and Ads

The App is free to download. Core tools are available with ads, including rewarded ads that grant in-app credits when you choose to watch them. Credits are a virtual in-app item with no cash value and are non-refundable and non-transferable except as required by law.

Optional subscriptions (weekly, monthly, or yearly) and credit packs are sold through Google Play Billing or the Apple App Store. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel in your Google Play or App Store account settings. Refunds are handled under the applicable store's policy and your local consumer law.

6. Acceptable Use

You agree not to use the App unlawfully; disrupt or interfere with it; bypass paywalls, ads, or access controls; use bots or scrapers; or infringe intellectual property. We may suspend or terminate access for violations.

7. Intellectual Property

The App, its design, trademarks, and our content are owned by Tranquil Mind Technology JSC and its licensors. Third-party marks belong to their owners; their appearance does not imply affiliation or endorsement.

8. Third-Party Services and Content

The App uses third-party services (advertising, analytics, payment processing, and AI generation providers such as getimg.ai and fal.ai), each subject to its own terms. We are not responsible for third-party services or their content.

9. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind. AI output is not professional advice. We do not guarantee that the App will be uninterrupted, error-free, or secure, or that generated results will meet your expectations.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages. Our total liability is limited to the greater of the amounts you paid in the last 12 months or USD 50. Some jurisdictions do not allow certain limitations, so some may not apply to you.

11. Indemnification

You agree to indemnify Tranquil Mind Technology JSC against claims arising from your misuse of the App, your uploaded content, or your breach of these Terms.

12. Termination

We may suspend or terminate your access for any reason, including breach of these Terms. Sections on intellectual property, disclaimers, and limitation of liability survive termination.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Continued use of the App means you accept the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of Vietnam, with venue in Hanoi, Vietnam. Your mandatory local consumer rights are preserved.
