Terms of Use

Welcome to PitchSide ("PitchSide", "we", "our", or "us"). These Terms of Use ("Terms") govern your access to and use of the PitchSide mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old (or 16 in the EEA) to use the App. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Description of Service

PitchSide is a football information and community service that provides:

• Real-time match scores, fixtures, results, and event timelines
• Match statistics, head-to-head history, lineups, and formations
• Tournament tracking (group standings, knockout brackets, top-scorer races)
• Community features: live polls and prediction tips submitted by users
• Editorial informational content including match-preview cards ("Tips")

Tips & Predictions are informational only. Any prediction, tip, statistical insight, or odds-related content in the App is for entertainment and informational purposes only. It does not constitute betting advice, guarantee an outcome, or solicit wagers. PitchSide does not accept, broker, or process bets. Users must comply with all applicable laws in their jurisdiction regarding sports betting and gambling.

Match data comes from third-party sports data providers. While we strive for accuracy, we cannot guarantee data is error-free or always current.

Users are solely responsible for how they use the App and any content they submit or rely upon.

3. User Responsibilities

When using PitchSide, you agree that:

• You will use the App only for lawful purposes.
• You will respect copyright laws and intellectual property rights.
• You will not reproduce or distribute any copyrighted content without permission from the owner.
• You will not use the App to violate any local, national, or international laws.

4. User-Generated Content (Polls & Prediction Tips)

The App allows you to submit community content such as poll votes, prediction tips, comments, or reactions ("UGC"). By submitting UGC you agree that:

• You own or have the right to share the content you submit.
• Your UGC will not be unlawful, defamatory, hateful, or infringing on third-party rights.
• You grant PitchSide a worldwide, royalty-free licence to display, aggregate, moderate, and remove your UGC within the App and in connection with promoting the service.
• We may remove UGC and/or suspend your access without notice if it violates these Terms.
• Prediction tips and poll results are informational only — they do not constitute betting advice or a guarantee of outcome (see Section 2).

5. AI-Generated Content (if applicable)

If the App provides AI-generated outputs (images, text, audio, video, or recommendations), you acknowledge that:

• AI outputs may be inaccurate, biased, or unsuitable for any specific purpose.
• Outputs are not a substitute for professional advice (medical, legal, financial).
• You are solely responsible for reviewing, verifying, and using AI outputs.
• You will not generate content that is illegal, harmful, deceptive, defamatory, or that infringes on the rights of others (including deepfakes of real people without consent).
• Ownership of AI-generated content is governed by applicable law and the terms of the underlying AI provider.

6. In-App Purchases and Subscriptions

If the App offers in-app purchases, coins, or subscriptions:

• All purchases are processed by the Apple App Store or Google Play Store and subject to their terms.
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
• Refunds are handled by Apple or Google according to their respective refund policies.
• Virtual items (coins, credits) have no monetary value and are non-refundable except where required by law.

7. Intellectual Property

The App, including its design, features, logos, and software, is owned by PitchSide and protected by intellectual property laws.

You may not:

• Copy, modify, or distribute any part of the App
• Reverse engineer or attempt to extract the source code
• Use our trademarks without permission

All third-party content accessed through the App belongs to its respective owners.

8. Third-Party Services

The App may interact with third-party platforms or websites. PitchSide:

• Does not control third-party content
• Is not responsible for third-party services
• Makes no guarantees about availability or accuracy

Your use of third-party services is subject to their own terms and policies.

Affiliate & sponsored placements. The App may contain affiliate links, sponsor placements, or referral offers from sports content / sports-related service partners. PitchSide may receive a referral fee or commission when you engage with such offers. These placements are labelled where required by law or app-store policy. PitchSide does not operate as a bookmaker, sportsbook, or real-money gambling operator. Partner services operate under their own terms; PitchSide makes no warranty about partner conduct, payouts, or availability. Where required, partner placements are gated or removed per platform rules (e.g., Google Play Real-Money Gambling Policy).

9. Prohibited Uses

You agree not to:

• Use the App to infringe copyrights or other rights
• Distribute illegal, harmful, or deceptive content
• Generate or share non-consensual intimate imagery or deepfakes of real people
• Attempt to hack, decompile, or disrupt the App
• Use automated systems, bots, or scrapers to abuse the service
• Engage in any activity that harms PitchSide or other users

We reserve the right to suspend or terminate access for violations.

10. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that:

• The App will always function without interruption
• Downloads will always succeed
• The App will be error-free or fully secure
• AI outputs will be accurate or suitable for any purpose

Use of the App is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, PitchSide and its affiliates shall not be liable for:

• Loss of data, profits, or revenue
• Copyright disputes
• Indirect, incidental, special, consequential, or punitive damages
• Issues arising from third-party content or AI outputs

Our total aggregate liability shall not exceed the amount you paid to us in the 12 months preceding the claim (or USD $10 if no payment was made). Users assume full responsibility for their actions when using the App.

12. Indemnification

You agree to indemnify and hold harmless PitchSide from any claims, damages, or expenses arising from your misuse of the App, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate access to the App at any time, with or without notice, if users violate these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (IP, Disclaimer, Liability, Indemnification, Governing Law) will remain in effect.

14. Changes to These Terms

We may update these Terms from time to time. Material updates will be highlighted in-app or on our website with a revised "Last Updated" date. Continued use of the App after changes means you accept the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts of Vietnam, except where mandatory consumer protection laws of your country of residence provide otherwise.
