Terms of Service
These Terms of Service ("Terms") govern your use of the Onyx Browser mobile application ("the App"), operated by Tranquil Mind Technology JSC ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 16 years old (or the higher age of digital consent in your jurisdiction) to use the App.
2. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial purposes. You may not copy, modify, distribute, sell, lease, or reverse-engineer the App or any part of it, except to the extent this restriction is prohibited by applicable law.
3. The Service
Onyx Browser is a private, lightweight web browser with a built-in ad blocker; it lets you search the web, open and manage tabs, block ads and pop-ups, and set the App as your default browser. Availability and features may vary by region and may change over time. We may modify, suspend, or discontinue the App or any feature at any time.
4. Subscriptions, Purchases, and Ads
The App is free to download and is supported by advertising. Optional Onyx Premium subscriptions remove ads and unlock additional privacy features. Subscriptions are sold through Google Play Billing:
- Plans include a yearly plan (with a 3-day free trial), a monthly plan, and a weekly plan. Prices are shown in the App and may vary by region.
- Subscriptions auto-renew at the end of each billing period unless you cancel at least 24 hours before the period ends.
- You can manage or cancel your subscription any time in your Google Play account settings.
- Payment is charged to your Google Play account. Refunds are handled according to Google Play policy and applicable consumer-protection law.
5. Acceptable Use
You agree not to: use the App for any unlawful purpose; disrupt or interfere with the App or its security; bypass or circumvent ads, paywalls, or access controls; use bots, scrapers, or automated means to access the App; or infringe the rights of others. We may suspend or terminate your access for violations.
6. Intellectual Property
The App, its design, trademarks, and content are owned by Tranquil Mind Technology JSC or its licensors. Third-party trademarks and website content accessed through the browser belong to their respective owners; their appearance in or accessibility through the App does not imply affiliation or endorsement.
7. Third-Party Services and Content
The App uses third-party services (advertising, analytics, attribution, and payments) and lets you access websites and content operated by third parties, each subject to its own terms and policies. We do not control and are not responsible for third-party services or the content, accuracy, or practices of any website you visit through the App.
8. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not provide professional advice and do not guarantee that the App will be uninterrupted, error-free, or secure, or that ad blocking will block every advertisement.
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim relating to the App is limited to the greater of the amounts you paid us in the 12 months before the claim or USD 50. Some jurisdictions do not allow certain exclusions or limitations, so these may not fully apply to you.
10. Indemnification
You agree to indemnify and hold harmless Tranquil Mind Technology JSC from any claims, damages, or expenses arising out of your misuse of the App or your breach of these Terms.
11. Termination
We may suspend or terminate your access to the App at any time, including for breach of these Terms. Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted with a new "Last updated" date. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of Vietnam, and the venue for disputes is Hanoi, Vietnam. Your mandatory local consumer rights are preserved.
