Terms of Use
These Terms of Service ("Terms") govern your use of the Lumio AI mobile application (the "App"), operated by Tranquil Mind Technology JSC ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 16 years old (or the higher age of digital consent in your country) to use the App. By using it, you represent that you meet this requirement.
2. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial purposes. You may not copy, modify, distribute, sell, lease, or reverse-engineer the App except to the extent this restriction is prohibited by applicable law.
3. The Service
Lumio AI is an AI video generator that creates short AI-generated videos from your text prompts and photos, with effect templates, an on-device gallery, and sharing. Availability and features may vary by region and may change over time. We may modify, suspend, or discontinue any part of the App at any time.
4. Content You Submit and AI-Generated Output
- Your input. You are solely responsible for the photos and prompts you submit. You represent that you own or have the necessary rights and permissions to any photo you upload, and that your input does not infringe anyone's rights or violate any law.
- Acceptable content. You must not submit or generate content that impersonates a real person without consent, is sexually explicit or involving minors, is defamatory, harassing, hateful, deceptive, or otherwise unlawful. Do not use the App to create deepfakes or misleading media of real individuals.
- AI output. Videos are generated by artificial intelligence and may be inaccurate, unrealistic, or unexpected. To the extent permitted by law, you are responsible for how you use the output, and you retain your rights in your own input subject to the license needed to operate the service (Section 3 of the Privacy Policy).
5. Subscriptions, Purchases, and Ads
The App is free to download. It contains ads, including rewarded ads: you may choose to watch an ad to earn in-app credits, which have no monetary value and are not redeemable for cash. The App offers consumable credit packs and optional Lumio Premium subscriptions (weekly, monthly, or lifetime) purchased through Google Play Billing. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period; manage or cancel in your Google Play account settings. Refunds are handled according to Google Play policy and applicable consumer law.
6. Acceptable Use
You agree not to: use the App unlawfully; disrupt or interfere with the App or its servers; bypass paywalls, ads, credit limits, or access controls; use bots, scrapers, or automated means; or infringe intellectual property or other rights. We may suspend or terminate access for violations.
7. Intellectual Property
The App, its design, software, trademarks, and our content are owned by Tranquil Mind Technology JSC or its licensors. Third-party names and marks belong to their owners; their appearance does not imply affiliation or endorsement. "fal.ai", "Google", "AdMob", "Meta", and "AppsFlyer" are trademarks of their respective owners.
8. Third-Party Services and Content
The App uses third-party services (advertising, analytics, attribution, payment processing, and AI video generation), each subject to its own terms and privacy policies. We are not responsible for third-party services or their content.
9. Disclaimers
The App and all AI-generated output are provided "as is" and "as available", without warranties of any kind, express or implied. We do not provide professional advice and do not warrant that the App will be uninterrupted, error-free, or secure, or that generated content will meet your expectations.
10. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim is limited to the greater of the amounts you paid to us in the 12 months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Tranquil Mind Technology JSC from any claims, damages, or expenses arising from your misuse of the App, your submitted or generated content, or your breach of these Terms.
12. Termination
We may suspend or terminate your access at any time, including for breach of these Terms. Sections on intellectual property, disclaimers, limitation of liability, and indemnification survive termination.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Your continued use of the App after changes take effect constitutes acceptance.
14. Governing Law and Disputes
These Terms are governed by the laws of Vietnam. The venue for disputes is Hanoi, Vietnam. Mandatory consumer-protection rights available to you under your local law are preserved.
