Terms of Service

These Terms of Service ("Terms") govern your use of the Fetchly Downloader mobile application ("the App"), operated by Tranquil Mind Technology JSC ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the higher age of digital consent in your jurisdiction) to use the App.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial purposes. You may not copy, modify, distribute, sell, or reverse-engineer the App except to the extent permitted by law.

3. The Service

Fetchly Downloader is a video and file downloader with a built-in offline player and library: you paste a link and the App saves the video, audio, or file to your device to view offline. Availability may vary by region and may change over time; we may modify, suspend, or discontinue the App or any feature at any time.

4. Ads

The App is free to download and is supported by third-party advertising. The App does not offer in-app purchases or subscriptions. Advertising is provided through the partners described in our Privacy Policy and may be personalized where you consent.

5. Acceptable Use and Your Responsibility for Content

You agree not to use the App for any unlawful purpose, to disrupt or interfere with the App, to bypass advertising or access controls, or to use bots/scrapers.

You are solely responsible for the content you download, save, or share using the App. You must have the necessary rights or permission to download any content, and you must comply with the terms, policies, and applicable copyright and other laws of the platforms and creators whose content you access. The App is a general-purpose tool; do not use it to infringe intellectual property rights or to download content you are not authorized to obtain. We may suspend or terminate access for violations.

6. Intellectual Property

The App, its design, trademarks, and our own content are owned by Tranquil Mind Technology JSC and its licensors. Third-party trademarks, logos, and content belong to their respective owners; their appearance in the App does not imply affiliation or endorsement.

7. Third-Party Services and Content

The App uses third-party services (advertising, analytics, infrastructure) and lets you access third-party content and links, each subject to its own terms and privacy policies. We do not own or control third-party content and are not responsible for it.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not provide professional advice and do not guarantee that the App will be uninterrupted, error-free, secure, or that any particular content can be downloaded.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim is limited to the greater of the amounts you paid us in the last 12 months or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Tranquil Mind Technology JSC from any claims or damages arising out of your misuse of the App, your downloaded content, or your breach of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time, including for breach of these Terms. Sections relating to intellectual property, disclaimers, and limitation of liability survive termination.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Continued use of the App after changes take effect constitutes acceptance.

13. Governing Law and Disputes

These Terms are governed by the laws of Vietnam, with venue in Hanoi, Vietnam. Mandatory local consumer protections that apply to you are preserved.
