Terms of Service

These Terms of Service ("Terms") govern your use of the Zephlix mobile application ("the App"), operated by Tranquil Mind Technology JSC ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. What Zephlix Is — and What It Is Not

Zephlix is a media player. It reads playlists that you supply — an M3U/M3U8 link, an Xtream Codes account, or a local .m3u file — and plays the live channels, films and series those sources contain. It also links to a small set of publicly available news channels, including official YouTube live streams played inside YouTube's own embedded player.

Zephlix does not provide, host, store, stream, index, aggregate, or sell any channel, film, series, or other media. It ships with no catalogue of paid content and no means of finding one. It is a tool, comparable to a video player or a web browser: what you watch through it is entirely determined by the sources you choose to add.

2. Eligibility

You must be at least 16 years old, or the higher age of digital consent that applies where you live, to use the App. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.

3. Your Playlists and Your Responsibility for Them

This section is the most important part of these Terms. By adding a playlist, server, or stream to the App, you represent and warrant that:

1. You have the legal right to access and view that content in your jurisdiction — whether through a subscription you pay for, a licence you hold, a free-to-air broadcast, or content in the public domain.
2. You will not use the App to access, redistribute, or publicly perform content in a way that infringes the copyright, broadcasting rights, or other intellectual-property rights of any third party.
3. You will comply with the terms of service of any provider whose service you use with the App.

You are solely responsible for the sources you add and for the consequences of adding them. We do not verify, endorse, monitor, or control any playlist, server, or stream. We have no relationship with the operators of those servers, no ability to inspect what they carry, and no means of removing content from them. Any dispute concerning a stream is between you and the provider of that stream.

4. Reporting an Infringement

Although we host no content, we take intellectual-property rights seriously. If you are a rights holder and believe the App's built-in curated channel list links to a feed that infringes your rights, contact contact@tranquilmind.co with the channel name, the URL as it appears in the App, a description of the right you hold, and your contact details. We will review the report and, where the claim is substantiated, remove the link in the next release.

We cannot act on reports concerning playlists that individual users add to their own devices; those are not visible to us and are not within our control.

5. Licence

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial purposes.

You may not copy, modify, adapt, translate, or create derivative works of the App; reverse-engineer, decompile, or disassemble it, except to the extent that applicable law expressly permits notwithstanding this restriction; rent, lease, lend, sell, redistribute, or sublicense it; remove or obscure any proprietary notice; or use it to build a competing product.

6. Availability and Changes to the Service

We may modify, suspend, or discontinue the App or any of its features at any time, with or without notice. Features that depend on third parties — Chromecast, YouTube embedding, programme-guide parsing, external-player handoff — may stop working if those third parties change or withdraw their services, and we are not liable for that. Availability may vary by region.

7. Advertising

Zephlix is free to download and free to use, and is funded by advertising. There are no in-app purchases and no subscriptions in the App, and we will never ask you for payment details.

By using the App you accept that ads will be displayed, including on the splash screen, in feeds, and between screens. Where required by law, the App asks for your consent before showing personalised ads; declining means you continue to see ads, but non-personalised ones. Advertising practices are described in Section 3 of our Privacy Policy. We are not responsible for the content of advertisements, for advertisers' websites, or for any transaction you enter into with an advertiser.

Interfering with the display of advertising — by blocking, spoofing, automating, or falsifying ad requests or impressions — is a breach of these Terms.

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose, or to access content you have no right to access;
• Use the App to infringe intellectual-property rights or to facilitate piracy;
• Interfere with, disrupt, or place undue load on the App or any server it connects to;
• Circumvent, disable, or defeat any security feature, access control, parental control, or advertising mechanism;
• Use bots, scrapers, automation, or emulator farms to interact with the App or its ads;
• Repackage, redistribute, or publish modified versions of the App.

We may suspend or terminate your access to the App for any violation of this section.

9. Intellectual Property

The App itself — its software, source code, interface, design, layout, graphics, brand name, and logo — is owned by Tranquil Mind Technology JSC and its licensors, and is protected by copyright, trademark, and other laws.

All channel names, programme titles, logos, and trademarks that appear through the App belong to their respective owners. Their appearance does not imply any affiliation with, sponsorship by, or endorsement from those owners. The built-in news channels are linked from their publishers' own public feeds and remain the property of those publishers; Zephlix is not affiliated with, endorsed by, or sponsored by any broadcaster.

10. Third-Party Services and Content

The App uses third-party services for advertising, analytics, crash reporting, attribution, and casting, and plays media delivered by third-party servers. Each of those is governed by its own terms and privacy policy. We are not responsible for third-party services or content, for their availability, accuracy, or legality, or for any loss arising from your use of them. The YouTube playback feature is subject to the YouTube Terms of Service (youtube.com/t/terms).

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, timely, secure, or error-free; that any particular stream, playlist, programme guide, or cast device will work; or that defects will be corrected. We make no representation as to the legality, quality, or availability of any content reached through the App, because we neither supply nor control it.

The parental-control feature filters categories by the names your playlist supplies. It is a convenience, not a content-classification or child-protection system, and it cannot detect unlabelled or mislabelled content. Do not rely on it as the sole safeguard for a device a minor uses.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRANQUIL MIND TECHNOLOGY JSC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP — INCLUDING ANY CLAIM ARISING FROM CONTENT ACCESSED THROUGH PLAYLISTS YOU ADDED.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM — WHICH, BECAUSE THE APP IS FREE AND HAS NO PURCHASES, IS ORDINARILY ZERO — OR (B) FIFTY UNITED STATES DOLLARS (USD 50).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. Where that is the case, the exclusions above apply only to the extent permitted, and nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.

13. Indemnification

You agree to indemnify, defend, and hold harmless Tranquil Mind Technology JSC and its officers, employees, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of or relating to: your use or misuse of the App; the playlists, servers, or streams you add; your breach of these Terms; or your violation of any law or of any third party's rights, including intellectual-property rights.

14. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access at any time, with or without notice, for any reason, including breach of these Terms. Sections 3, 9, and 11 through 16 survive termination.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted at https://policy.tranquilmind.co/zephlix/terms with a revised "Last updated" date. Continued use of the App after a change takes effect constitutes acceptance of the revised Terms. If you do not accept them, stop using the App.

16. Governing Law and Disputes

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles. The courts of Hanoi, Vietnam shall have jurisdiction over any dispute arising from these Terms or the App.

Nothing in this section deprives you of the protection of the mandatory consumer-protection rules of the country in which you habitually reside, or of your right to bring proceedings before the courts of that country where applicable law grants it.

17. General

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App. If any provision is held invalid or unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
