Terms of Service

These Terms of Service ("Terms") govern your use of the Skylark TV mobile application ("the App"), operated by Tranquil Mind Technology JSC ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old (or the higher age of digital consent in your jurisdiction) to use the App.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial purposes. You may not copy, modify, distribute, sell, or reverse-engineer the App except to the extent the law expressly permits.

3. The Service

Skylark TV is a media player for IPTV playlists: you add your own M3U / M3U8 or Xtream Codes playlists and watch live TV, movies, and series, with an EPG guide, Chromecast support, external-player handoff, and parental controls. Skylark TV does not provide, host, curate, or sell any channels, movies, or series — all content comes from the playlists you add yourself. Availability of features may vary by region and change over time, and we may modify, suspend, or discontinue the App or any feature.

4. Ads and Purchases

The App is free to download and use and is supported by advertising. The App has no subscriptions and no in-app purchases. Advertising is provided through third-party networks as described in our Privacy Policy; where required, you will be asked for consent to personalized ads.

5. Your Content and Acceptable Use

You are solely responsible for the playlists, URLs, and credentials you add to the App and for ensuring you have the legal right to access and view that content. You agree not to use the App for any unlawful purpose; to infringe any third party's intellectual-property or other rights; to access or distribute content you are not authorized to use; to disrupt the App; to bypass ads or access controls; or to use bots or scrapers. We may suspend or terminate your access for violations.

6. Intellectual Property

The App, its design, software, and trademarks are owned by Tranquil Mind Technology JSC and its licensors. Channels, movies, series, logos, and other content accessed through your playlists belong to their respective owners; their appearance in the App does not imply any affiliation with, or endorsement by, us. Third-party marks belong to their owners.

7. Third-Party Services and Content

The App uses third-party services (advertising, analytics, attribution) and plays third-party content supplied by your playlists, each subject to its own terms. We do not control and are not responsible for third-party services or content, including the legality, quality, or availability of the streams your playlists point to.

8. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any particular content will be available. Nothing in the App is professional advice.

9. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to the App will not exceed the greater of the amounts you paid us in the 12 months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Tranquil Mind Technology JSC from any claims, damages, or expenses arising from your misuse of the App, your playlists or content, or your breach of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time, including for breach of these Terms. Sections on intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Continued use of the App after changes take effect means you accept the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of Vietnam, with venue in Hanoi, Vietnam. Your mandatory local consumer rights are preserved.
