Terms of Service

These Terms of Service ("Terms") govern your use of the Pixarel mobile application ("the App"), operated by Tranquil Mind Technology JSC ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to our Privacy Policy (https://policy.tranquilmind.co/pixarel/privacy). If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old — or older, where your country sets a higher age of digital consent — to use the App. If you are a minor in your jurisdiction, you may use the App only with the involvement of a parent or guardian.

2. License

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the App for your own non-commercial purposes. You may not copy, modify, distribute, sell, lease, decompile or reverse-engineer the App or any part of it, except to the extent the law expressly permits.

3. The service

Pixarel generates artwork from a text prompt or from a photo you choose, offers ready-made style templates and AI tools (photo restoration, object removal, recolouring, makeup retouch, frame expansion, instant-photo look and figurine), and includes an on-device photo editor with crop, rotate, filters and colour adjustments.

Generation requires an internet connection: your prompt and, where applicable, the photo you select are sent to our image service to be processed. Availability, styles, tools and limits may vary by region and may change, and we may modify, suspend or discontinue any part of the service.

4. AI-generated content

Results are produced by automated systems. They may be inaccurate, unexpected, stylistically inconsistent or unsuitable for your purpose, and identical prompts may produce different results. Review any result before you save, publish or share it. We make no representation that a generated image is original, non-infringing, or fit for any particular use, including commercial use.

To the extent we can grant them, rights in the images you generate are yours. You are responsible for what you generate and for how you use it, including obtaining the consent of any person whose photograph you upload.

5. Acceptable use

You must not use the App to create, request, upload or share content that:

sexualises a minor in any way, or constitutes child sexual abuse or exploitation material — this is prohibited absolutely and is addressed in the Child Safety Standards section of our Privacy Policy;
is sexually explicit, pornographic or gratuitously violent;
promotes hatred, harassment, self-harm or terrorism;
depicts a real, identifiable person without their consent, or is intended to deceive, defame or impersonate;
infringes copyright, trademark, privacy or publicity rights.

You must not attempt to bypass the App's content filters, automate or scrape the service, overload it, or circumvent any access control or paid feature. We may refuse a request, remove content and suspend or terminate your access for any violation.

6. Reporting

Every generated result carries a Report button. Use it to flag sexual or explicit content, violence or gore, hate or harassment, or anything else you consider wrong. We review every report. You may also email us at contact@tranquilmind.co.

7. Purchases

The App is free to download and contains no advertising. Results created with the free version may carry a small Pixarel watermark, some templates are reserved for Pixarel Pro, and daily generation limits may apply to all users. Where optional paid features such as Pixarel Pro (weekly or yearly subscriptions, or a one-time lifetime purchase) are offered, they are sold exclusively through Google Play Billing or the Apple App Store. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you can cancel or manage them in your Google Play or App Store account settings. Prices and any free-trial terms are shown in the App before you confirm; if a free trial is offered, you are charged when it ends unless you cancel at least 24 hours before. Refunds are handled according to the relevant store's policy and your local consumer-law rights.

8. Intellectual property

The App, its design, its name and its trademarks are owned by Tranquil Mind Technology JSC or its licensors. Third-party marks, styles or names referenced in the App belong to their respective owners; their appearance does not imply affiliation or endorsement. Style names in the App describe a visual treatment and are not claims of association with any studio, artist or brand.

9. Third-party services

The App relies on third-party services — our image-generation infrastructure, and Google Firebase for crash reporting, usage measurement and configuration. Each is governed by its own terms and privacy policy, and we are not responsible for them.

10. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free or secure, or that any result will meet your expectations. Nothing in the App constitutes professional advice.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, images, profits or goodwill. Our total liability is limited to the greater of the amount you paid us in the twelve months before the claim or USD 50. Some jurisdictions do not allow these exclusions, in which case they apply only to the extent permitted.

12. Indemnification

You agree to indemnify and hold harmless Tranquil Mind Technology JSC from any claim, loss or expense arising out of your misuse of the App, the content you generate or upload, or your breach of these Terms.

13. Termination

We may suspend or terminate your access at any time, including for breach of these Terms. Sections on intellectual property, disclaimers, limitation of liability and indemnification survive termination.

14. Changes to these Terms

We may update these Terms. Material changes will be posted on this page with a new "Last updated" date. Continuing to use the App after a change means you accept the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws of Vietnam, with venue in Hanoi, Vietnam. Mandatory consumer-protection rights available to you under the law of your country of residence are preserved.
