Terms of Service

These Terms of Service ("Terms") govern your use of the Obsidian Browser mobile application ("the App"), operated by Tranquil Mind Technology JSC ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old (or the higher age of digital consent in your jurisdiction) to use the App. As a general-purpose web browser, the App provides access to content across the internet and is not intended for minors.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use. You may not copy, modify, distribute, sell, or reverse-engineer the App except to the extent permitted by law.

3. The Service

Obsidian Browser is a web browser that lets you search and browse the internet and includes a built-in ad blocker that helps block ads and pop-ups on the websites you visit. The ad blocker operates within the App's own browser and may not block every advertisement. Availability and features may vary by region and change over time, and we may modify, suspend, or discontinue the App or any feature.

4. Subscriptions, Purchases, and Ads

The App is free to download and is supported by advertising. Optional Premium subscriptions remove the App's ads and unlock additional features, and are sold through Google Play Billing as weekly, monthly, and annual plans (an introductory free trial may be offered on the annual plan). Prices are shown in the App before you confirm.

Subscriptions auto-renew at the then-current price unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription anytime in your Google Play account settings. Any free-trial period, if unused, is forfeited when you purchase a subscription. Refunds are handled according to Google Play policy and applicable consumer law.

5. Acceptable Use

You agree not to use the App for any unlawful purpose, to disrupt or interfere with the App or its security, to bypass paywalls, ads, or access controls, to use bots or scrapers, or to infringe others' rights. We may suspend or terminate access for violations.

6. Intellectual Property

The App, its design, and our trademarks are owned by Tranquil Mind Technology JSC and its licensors. Websites and content you access through the App belong to their respective owners; third-party marks belong to their owners, and their appearance does not imply affiliation.

7. Third-Party Services and Content

The App uses third-party services (advertising, analytics, payments) and enables access to third-party websites and content, each subject to its own terms and policies. We do not create, own, or control third-party content and are not responsible for it.

8. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind. We do not provide professional advice and do not guarantee uninterrupted, error-free, or fully secure operation, or that the ad blocker will block all advertisements.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages. Our total liability is limited to the greater of the amounts you paid in the last 12 months or USD 50. Some jurisdictions do not allow certain limitations, so some may not apply to you.

10. Indemnification

You agree to indemnify Tranquil Mind Technology JSC for claims arising from your misuse of the App or breach of these Terms.

11. Termination

We may suspend or terminate your access for any reason, including breach of these Terms. Sections on intellectual property, disclaimers, and limitation of liability survive termination.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Continued use of the App after changes take effect constitutes acceptance.

13. Governing Law and Disputes

These Terms are governed by the laws of Vietnam, with venue in Hanoi, Vietnam. Mandatory local consumer rights are preserved.
