Terms of Use

Welcome to Locato ("Locato", "we", "our", or "us"). These Terms of Use ("Terms") govern your access to and use of the Locato mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old (16 in the EEA) and have the legal capacity to accept these Terms. By using Locato, you confirm you meet this requirement.

2. Description of Service

Locato is a consent-based location-sharing app for personal, non-commercial use. It lets you share your live location with people you connect with, see them on a map, receive place (geofence) alerts, view location history, send an Emergency SOS, and use tools such as compass, speedometer, and nearby places.

3. Consent and Acceptable Use (Important)

Locato is designed for sharing location only between people who mutually agree to it.

• You may connect only with people who knowingly consent to share their location with you and to receive yours.
• You must not use Locato to locate, monitor, or track any person without their knowledge and explicit consent, including partners, employees, or children who are not under your lawful guardianship.
• If you share the location of a minor in your care, you are responsible for doing so lawfully.

Using the App to stalk, harass, or covertly surveil any person is strictly prohibited and may result in immediate termination and reporting to authorities.

4. User Responsibilities

You agree to use the App lawfully, to provide accurate connection information, to respect the privacy and rights of others, and to comply with all applicable laws.

5. Location Accuracy and No Emergency Reliance

Location data depends on your device, GPS, network, and environment and may be delayed, approximate, or unavailable. Locato is provided for convenience and is not a substitute for emergency services or professional safety, security, or navigation solutions. Do not rely on it as your only tool in an emergency.

6. In-App Purchases and Subscriptions

Purchases are processed by the Apple App Store or Google Play under their terms. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period. Purchases are generally non-refundable except where legally required.

7. Intellectual Property

Locato owns the App, including its design and software, protected by intellectual property laws. You may not copy, modify, distribute, reverse engineer, or use our trademarks without permission. Third-party content belongs to its respective owners.

8. Third-Party Services

The App integrates external services (e.g., Google Maps, Firebase, advertising networks). We are not responsible for their availability, accuracy, or content. Your use of them is governed by their own terms.

9. Prohibited Uses

You must not: track any person without consent; harass, stalk, or endanger others; violate any law; infringe intellectual property; hack or disrupt the App; use automated abuse systems; or harm Locato or its users. Violations may result in termination.

10. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind. We do not guarantee uninterrupted operation, accuracy, or fitness for a particular purpose. You accept all risks of use.

11. Limitation of Liability

To the maximum extent permitted by law, Locato shall not be liable for indirect, incidental, or consequential damages, or loss of data, profits, or revenue. Our maximum liability equals the amounts you paid in the preceding 12 months (minimum USD $10).

12. Indemnification

You agree to hold Locato harmless from claims, damages, and expenses arising from your misuse of the App, violation of these Terms, or infringement of third-party rights.

13. Termination

We may suspend or terminate access at any time for violations, with or without notice. You may stop using and uninstall the App at any time. Provisions that by their nature should survive termination will survive.

14. Changes to These Terms

We may update these Terms periodically. Material changes will be notified in-app or on our website with an updated date. Continued use indicates acceptance.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Socialist Republic of Vietnam. Disputes will be resolved through good-faith negotiation first, then the courts of Vietnam, except where local consumer laws provide otherwise.
