Terms of Service

These Terms of Service ("Terms") govern your use of the GPSage mobile application ("the App"), operated by Tranquil Mind Technology JSC ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to our Privacy Policy (https://policy.tranquilmind.co/gpsage/privacy). If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or older if the age of digital consent in your country is higher) to use the App. If you are under the age of majority where you live, you may use the App only with the involvement and permission of a parent or legal guardian.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, decompile or reverse-engineer the App, except as the law expressly allows.

3. The service

GPSage is a family locator and GPS utility. It lets you:

share your live location with contacts you approve, on a shared map;
set safe zones and receive arrival and departure alerts;
turn on an SOS status that your contacts can see;
take GPS-stamped photos and videos;
find nearby places;
use tools such as a compass, speedometer, level, stopwatch, area-code lookup, world clock and weather.

Features and availability may vary by device and region and may change over time. We may modify, suspend or discontinue any part of the App at any time.

4. Your profile, connection code, and contacts

The App creates a profile identified by a randomly generated connection code. There is no username or password, so anyone who has your connection code or QR code can send you a connection request. Share them only with people you trust.
You are responsible for the information you add to your profile (display name, phone number, profile photo). It must be accurate and must not violate these Terms or anyone's rights.
You grant us a worldwide, non-exclusive, royalty-free license to store, process and display your profile information and location to your approved contacts, only as needed to operate the App.
You can turn off location sharing or remove a contact at any time. To delete your profile data, follow the instructions in the Privacy Policy.

Location sharing requires consent. Each person uses the App on their own device, accepts connection requests, and controls their own sharing. You may share and view locations only with the knowledge and agreement of everyone involved, and only in compliance with applicable law.
Do not use the App to track, monitor or locate anyone without their knowledge and consent. This includes installing it on another person's device or changing their settings without permission. You may use the App to share location with a minor only if you are that minor's parent or legal guardian, or have their permission, and only in line with local law.
Not an emergency service. The SOS feature only shows your SOS status to your GPSage contacts. It does not contact emergency services, and your contacts may not see it in time. In an emergency, call your local emergency number.
Accuracy. Location, speed, heading, altitude, address, weather and alert information depends on your device's GPS and sensors, network connection, permissions, battery settings and third-party data. It may be delayed, inaccurate or unavailable. Do not rely on the App for navigation, safety-critical, legal or evidentiary purposes.
Background location, notifications and battery-optimization settings must be enabled for sharing and alerts to work reliably. You can change these permissions at any time in your device settings.

6. Ads

The App is free to download and use, and it is supported by advertising. Ads are provided by third-party ad networks. Where required, we ask for your consent before showing personalized ads. The App does not offer in-app purchases or subscriptions.

7. Acceptable use

You agree not to:

use the App for any unlawful purpose, or to stalk, harass, threaten, intimidate or harm anyone;
track or monitor any person without their consent;
upload or display content — including profile photos or display names — that is sexual, violent, hateful, defamatory or infringing, or that impersonates another person;
create, share, request or promote child sexual abuse material, or use the App to groom, exploit or endanger minors in any way (see the Child Safety Standards in our Privacy Policy). We report apparent child sexual abuse material to NCMEC and/or the relevant authorities;
guess, collect, scrape or misuse other users' connection codes or data, or access data you are not authorized to see;
interfere with, disrupt, overload or attempt to gain unauthorized access to the App, its servers or its data;
use bots, scrapers or automated means to access the App, or tamper with ads or access controls.

We may remove content, delete profiles and suspend or terminate access for violations. We may also report violations to law enforcement.

8. Intellectual property

The App, including its software, design, text, graphics, stamp templates and trademarks, is owned by Tranquil Mind Technology JSC or its licensors and is protected by intellectual property laws. Photos and videos you take with the App belong to you. Third-party names and marks (including Google, Google Maps, Open-Meteo and ad-network names) belong to their owners. Their appearance in the App does not imply affiliation or endorsement.

9. Third-party services and content

The App relies on third-party services for maps, geocoding, nearby places, weather, cloud storage, notifications, analytics, attribution and advertising. Each is subject to its own terms and privacy policy. We are not responsible for third-party services, content, websites or apps, including content opened from nearby-place results or ads.

10. Disclaimers

To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied. This includes warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the App will be uninterrupted, timely, error-free or secure, that locations or alerts will be accurate or delivered, or that the App will meet your safety needs.

11. Limitation of liability

To the fullest extent permitted by law:

Tranquil Mind Technology JSC is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. This includes harm arising from reliance on location, SOS or alert information, or from any third party's misuse of information you chose to share.
Our total liability for any claim relating to the App is limited to the greater of the amounts you paid us in the 12 months before the claim or USD 50.

Some jurisdictions do not allow these exclusions or limits, so they may not fully apply to you.

12. Indemnification

You agree to indemnify and hold harmless Tranquil Mind Technology JSC and its officers, employees and partners from claims, losses and expenses (including reasonable legal fees) arising from your misuse of the App, your content, your violation of these Terms, or your violation of any law or third-party right, including tracking a person without consent.

13. Termination

You may stop using the App at any time and request deletion of your data as described in the Privacy Policy. We may suspend or terminate your access at any time, including for breach of these Terms. Sections 4 (license to your content, as needed to complete deletion), 8, 10, 11, 12 and 15 survive termination.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use of the App after changes means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. Disputes will be resolved by the competent courts of Hanoi, Vietnam. Nothing in these Terms limits any mandatory consumer rights you have under the laws of your country of residence.
