Terms of Service
These Terms of Service ("Terms") govern your use of the Ember Drama mobile application ("the App"), operated by Tranquil Mind Technology JSC ("we", "us", "our"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 16 years old (or the higher age of digital consent in your jurisdiction) to use the App. The App contains mature dramatic themes and is not intended for children. By using the App, you represent that you meet this age requirement.
2. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial entertainment. You may not copy, modify, distribute, sell, lease, or reverse-engineer the App or any part of it, except to the extent this restriction is prohibited by applicable law.
3. The Service
Ember Drama is a short-form drama streaming app that lets you watch episodic romance, billionaire, werewolf, and mafia series. Content and availability may vary by region and change over time. We may modify, suspend, or discontinue any part of the App at any time, with or without notice.
4. Subscriptions, Purchases, and Ads
The App is free to download and is supported by ads. Some content may be unlocked either by watching an ad ("watch with ads") or by purchasing premium access.
- The App offers optional weekly and monthly subscriptions and a one-time lifetime purchase, which remove ads and/or unlock content.
- Purchases and subscriptions are processed through Google Play Billing. Payment is charged to your Google Play account at confirmation.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period. You can manage or cancel subscriptions anytime in your Google Play account settings.
- Refunds are handled according to Google Play's policies and any non-waivable consumer-protection rights you have under applicable law.
5. Acceptable Use
You agree not to: use the App for any unlawful purpose; disrupt or interfere with the App or its servers; bypass, disable, or circumvent paywalls, ads, or access controls; use bots, scrapers, or other automated means to access the App or its content; or infringe our or any third party's rights. We may suspend or terminate your access for any violation.
6. Intellectual Property
The App, its design, software, trademarks, and content are owned by Tranquil Mind Technology JSC or its licensors and are protected by intellectual-property laws. All series and characters are works of fiction; any resemblance to real persons or events is coincidental. Third-party trademarks and content belong to their respective owners; their appearance in the App does not imply affiliation or endorsement.
7. Third-Party Services and Content
The App uses third-party services (including advertising, analytics, and payment providers) and streams licensed and/or third-party content, each of which is subject to its own terms and policies. We are not responsible for third-party services or content, including their availability, accuracy, or practices.
8. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. The App is for entertainment only and does not provide professional advice. We do not warrant that the App will be uninterrupted, error-free, or secure.
9. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits. Our total liability for any claim relating to the App will not exceed the greater of the amounts you paid us in the 12 months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Tranquil Mind Technology JSC and its affiliates from any claims, damages, or expenses arising out of your misuse of the App or your breach of these Terms.
11. Termination
We may suspend or terminate your access to the App at any time, including for breach of these Terms. Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of Vietnam, and the venue for disputes is Hanoi, Vietnam, without prejudice to any mandatory local consumer-protection rights available to you in your country of residence.
